AGREEMENT BETWEEN USER AND EAST NORTHPORT JEWISH CENTER

Welcome to East Northport Jewish Center (hereinafter "ENJC"). We maintain the www.enjc.net website (hereinafter the "ENJC Web Site") as a service to You. By using our site, you are agreeing to comply with and be bound by the following terms of use, terms, conditions, and notices contained herein. Please review the following terms carefully.

This Terms of Use Agreement (hereinafter called the "Agreement") are between ENJC and You, hereinafter called the ("You," "You" or "Your")

1. Acceptance of Agreement

You agrees to the terms and conditions outlined in this Agreement with respect to the ENJC Web Site. This Agreement constitutes the entire and only Agreement between the You and ENJC, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the ENJC Web Site, the content, products or services provided by or through the ENJC Web Site, and the subject matter of this Agreement. This Agreement may only be amended by a duly executed signed writing by both You and ENJC.

You do not acquire ownership rights to any content, document or other materials viewed through the ENJC Web Site. The posting of information or materials on the ENJC Web Site does not constitute a waiver of any right in such information and materials.

The contents of this Web Site, and of all other websites under ENJC's control, whether partial or otherwise (the web site and such other web sites are sometimes collectively referred to as "ENJC Sites") such as text, graphics, images, logos, button icons, software and other Web Site content (collectively, "Web Site Content"), are protected under both United States and foreign copyright, trademark and other laws. All Web Site Content is the property of ENJC or its content suppliers or clients. The compilation (meaning the collection, arrangement, and assembly) of all content on this Web Site is the exclusive property of ENJC and is protected by U.S. and international copyright laws. Unauthorized use of the Web Site Content may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service-mark and other proprietary notices contained in the original Web Site Content on any copy you make of the Web Site Content. 3. Limited Right to Use

4. Editing, Deleting and Modification

6. Use of Information

ENJC reserves the right, and You authorize us, to the use and assignment of all information regarding Site uses by You and all information provided by You in any manner consistent with our Privacy Policy as set forth in Section 9. All remarks, suggestions, ideas, graphics, or other information communicated by ENJC to ENJC through the ENJC Web Site (collectively, the "Submission") will forever be the property of ENJC. Without limitation, ENJC will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. All rules, policies (including privacy policies) and operating procedures of Merchants will apply to You while on such sites. We are not responsible for information provided by You to Merchants. ENJC and the Merchants are independent contractors and neither party has authority to make any representations or commitments on behalf of the other.

9. Privacy Policy

Our Privacy Policy, as it may change from time to time, with or without notice, is a part of this Agreement.

You are advised that the Internet is not a secure system. ENJC has taken prudent steps to ensure that the information contained in its database is secure. ENJC reserves the right to monitor and/or terminate the activities of any user when said activities are adversely affecting ENJC services.

10. Links to other Web Sites

The ENJC Web Site may contain links to other Web sites. ENJC is not responsible for the content, accuracy or opinions express in such Web sites, and such Web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked Web site on ENJC's Site does not imply approval or endorsement of the linked Web site by ENJC. If You decide to leave ENJC's Site and access these third-party sites, You do so at your own risk.

The ENJC Web Site contains information and press releases about ENJC. 12. Choice of Law, Statute of Limitations, Construction, Severability, and Waiver

These Terms of Use will be governed by and construed in accordance with the laws of the State of New York, United States of America, without giving effect to its conflict of laws or your actual state or county of residence.

If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Use to be unenforceable, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.

You acknowledge that New York provides for varying statute of limitations (time in which a claim or lawsuit may be brought). Excluding claims for Intellectual Property Infringement, You agree that all statutes of limitations to bring any claim or lawsuit against ENJC shall be one year. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against either party.

ENJC makes no claims that the Materials may be lawfully viewed or accessed outside of the United States. Access to the Materials may not be legal by certain persons or in certain countries. If you access the Web Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms of Use are governed by the internal substantive laws of the State of New York, without respect to its content of law principles.

Any controversy or claims relating to this Agreement, as well as any other claim, dispute or issue, shall be submitted to binding arbitration in accordance with the provisions and procedures of the American Arbitration Association. In the event that any dispute is not subject to arbitration, such dispute shall be resolved in a proceeding held in and for the United States District Court for the Eastern District of New York or the Supreme Court of the State of New York, in and for the County of Suffolk, notwithstanding your actual state of residence, by a judge sitting without a jury (the parties having agreed to waive a jury trial), and you irrevocably consent to the jurisdiction of such courts and consent to extra-territorial service of process.

No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use for areas of the Web Site, a particular "Legal Notice," or Software License or material on particular Web pages, these Terms of Use constitute the entire agreement between You and ENJC with respect to the use of the Web Site. Any change to the terms and conditions contained in this Agreement must agreed to by representatives of both parties and in writing.

These Terms of Use constitute the entire Agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by You and ENJC.

To the extent that anything in or associated with the ENJC Web Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.

13. Use of Cookies

ENJC does not now, but may in the future, use "cookies" "Cookies" are small pieces of information that are stored by Your browser on your computer, and are commonly used by most Web sites to provide You with an enhanced experience if used by ENJC, our cookies will not contain any personally identifying information. Most Web browsers automatically accept cookies, but you can usually change your browser to inform you or prevent the use of cookies.

14. Log Files

Like most Web sites, we log the use of our service. This includes, but is not limited to, the type of report being requested and the number of records found that met the search criteria. This information is linked to the individual, logged-on user. ENJC also keeps logs of the Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks in order to administer the ENJC Web Site, track aggregate movement, analyze trends, and gather broad demographic information for aggregate use.

We are sensitive to the privacy and security of Your personal information. However, we cannot guarantee absolute security as such information may be transmitted using the Internet, other public telecommunication networks, servers, hardware or software ("systems") that are not owned, operated, or controlled by us.

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a judicial proceeding, a court order, or legal process served to us.

17. Newsletters

ENJC does not currently publish online newsletters. If ENJC does, at some time in the future publish an online newsletter, and if a user wishes to subscribe to our newsletter, we request an e-mail address. Out of respect for our users privacy, we enable subscribers to opt-out of these communications by following the Opting-Out practices outlined below.

18. Service Announcements

On rare occasions it may be necessary to issue a service related announcement (for instance, if our service is undergoing maintenance). These communications are not promotional in nature and users may not opt-out of these communications.

If a user's personally identifiable information changes (such as zip code, phone, e-mail or postal address), or if a user no longer desires our service, we provide a way to correct, update or delete/deactivate users' personally identifiable information. 22. Notification of Privacy Policy Changes

If we decide to change our privacy policy, we will post notification of those changes to this privacy statement on the home page so users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Alternatively we may simply notify users that this privacy statement has changed and they should review this agreement again to review said changes. We will use information in accordance with the privacy policy under which the information was collected. If however, we are going to use users' personally identifiable information in a manner different from that stated at the time of collection, we will notify users via e-mail. Users will have a choice as to whether or not we use their information in this different manner. However, if users have opted out of all communication with the ENJC Web Site, or deleted/ deactivated their account, then they will not be contacted, nor will their personal information be used in this new manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our Web site notifying users of the change. General Rules: Users may not use any ENJC Site in order to transmit, distribute, store or destroy material, including without limitation Web Site Content, (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.

Users are prohibited from violating or attempting to violate the security of any ENJC Site, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to any ENJC Site, overloading, "flooding", "spamming", "mail bombing" or "crashing", (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. As a condition of your use of the ENJC Web Site, you warrant to ENJC that you will not use the ENJC Web Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. ENJC has no obligation to monitor the Communication Services.
